L’articolo si propone di osservare il mutato approccio delle autorità di regolazione, tanto in chiave ex ante quanto in chiave ex post, con riferimento al fenomeno delle economie dei dati che stanno ormai ridefinendo gli assetti economici mondiali. In un primo momento, a carattere descrittivo, si osserva brevemente il fenomeno oggetto di regolazione: in chiave ex ante si seguiranno le proposte che la Commissione europea ha presentato sul tema, priorità dell’esecutivo europeo; in chiave ex post si seguirà l’evoluzione dell’approccio giurisdizionale (cartina tornasole della mutata sensibilità) per valutare l’attualità e l’efficacia dell’antitrust enforcement. Da ultimo, chiarito l’attuale quadro regolatorio, ci si sofferma sulla necessità di eventuali interventi di riforma sulla scia di un recente rapporto di indagine derivante dall’esperienza americana.
The article aims to observe the changed approach of the regulatory authorities, both in an ex ante and an ex post key, with reference to the phenomenon of data economies that are now redefining global economic assets. At first, of a descriptive nature, the phenomenon subject to regulation is briefly observed: in an ex ante key, the proposals that the European Commission has presented on the subject, a priority of the European executive, will be followed; in an ex post key, the evolution of the jurisdictional approach (test of changed sensitivity) will be followed to assess the relevance and effectiveness of antitrust enforcement. Finally, having clarified the current regulatory framework, we focus on the need for any reform measures in the wake in a recent survey report deriving from the American experience.
